As we wrap up our celebration of “freedom” and “independence”
we must remind ourselves, we are no longer the freest nation in the world…the
Patriot Act in particular pretty much destroyed our privacy and eroded
our Bill of Rights and few citizens even bothered to notice so I guess we
deserve what we have.
According
to the 2014 Legatum Prosperity Index released in November, in
the measure of personal freedom, the United States has fallen from 9th place in
2010 to 21st worldwide—behind such countries as Canada, the United Kingdom,
Germany, Uruguay and Costa Rica.
As
I’ve written before, in 1970 America had
more than 100 million laws on the books and under President Obama the amount or
rules, regulations and laws has more
than quadrupled in eight years…all of this has helped cripple our
ability to start businesses and create jobs.
When
I founded my publishing and seminar business in the mid-1980s, I didn’t pay
myself a salary. Like our Founding
Fathers, I took only expenses and in my case, I accepted royalties from books I
had written and speaking fees. Our
members of Congress could take note of this as most of them are wealthy, yet
take large salaries and gold plated benefits and often exclude themselves from
the onerous laws they force upon the public they supposedly serve.
Many
of the political elite too have become enormously wealthy as a result of their
political connections [the Clintons, in particular, are considered the most
wealthy former first family ever].
Attorney Harvey Silverglate argues that the average American
commits three felonies a
day
without even knowing it. Although it has been estimated that there are over 3,000 types of
federal criminal offenses, no one knows the exact number for sure.
At any given time, a police officer could walk up to you and
find you in violation of some arbitrary law. It is a mathematical certainty.
Nearly everything we fought the British over during the war of
Independence AND what we fought the Communists over for more than 50 years, we
have become…in short, we’ve been sold out by our own government.

Issue Legislators are running from the great
duties they were meant to discharge Washington is broken. The federal
government is a fiscal basket case, $19 trillion in debt and running massive
annual deficits as far as the eye can see. It is an abysmal steward of our
economy, managing dysfunctional tax and regulatory systems that expand
opportunity for the well connected while strangling it for everyone else. And
it imposes thousands of petty laws on the American people every year without
rhyme or reason, while failing to seriously consider solutions to our real
national challenges.
American politics in 2016 seems to
be a competition to assign blame for this.
The usual suspects offer up their favorite villains: Democrats and Republicans….but in this case the
problem is not partisan or idealogical; it’s structural. The reason the federal government is not
working today is that is isn’t working properly.
The constitutional order set up by
our Founders is breaking down.
Specifically, the awesome powers of federal legislative branch are
increasingly being exercised by the executive and judicial branches. Executive orders sometimes effectively
rewrite laws. Administrative agencies
seem to write whole new ones out of thin air.
Supreme Court rulings impose the policy preferences of five lawyers onto
a republic of 320 million citizens who have democratic recourse.
Conservatives have been warning
about this for years – more than ever during the presidency of Barack
Obama. But it seems we don’t take the
argument to its logical conclusion…
The Founders fully expected federal
officers to try to overstep their constitutional authority. That’s why they wrote the Constitution as
they did: first, to disperse political power, horizontally among the three
branches and vertically between the federal government and the states; and
second, by giving each branch tools to check and balance the others.
